A legal separation requires that parties address the same issues as a divorce, except the parties will not be divorced at the end of the case and will instead be considered legally separated. This means that the parties cannot remarry, and will have to continue to file their taxes as “married.” Legal separation may be appropriate for couples who have a need to continue health insurance coverage for one of the parties and some couples utilize this option for religious reasons.
